Responsibility For UGC Posted on or Through This Site

You are responsible for any User-Generated Content (UGC) you post. Home Contractor LLC will not be liable for any UGC under any circumstances. This means that you, and not Home Contractor LLC, are fully responsible for all UGC you post and may be held personally liable for comments that are defamatory, obscene, or libelous, or that violate these Terms of Use, any confidentiality obligations, or the rights of others. You represent and warrant that for all UGC: (i) you own or have all necessary rights, licenses, and permissions to use and grant Home Contractor LLC authority to use all intellectual property or proprietary rights therein; and (ii) you have obtained the appropriate consent and permission from each identifiable individual in the UGC to use their name, image, and likeness.

Since we do not control the UGC posted on or through this Site, we cannot and do not warrant or guarantee its truthfulness, integrity, suitability, or quality. You also acknowledge that by accessing this Site, you may come across UGC that you might find objectionable. We are not responsible for any UGC, including any errors or omissions therein.

• Disclose any UGC and the identity of the user who posted it in response to a subpoena or when we believe disclosure is appropriate to comply with the law or a court order, to prevent or investigate potential crimes or other legal violations, to protect Home Contractor LLC or others, or to enforce these Terms of Use.

• Terminate your access to and use of this Site, or modify, edit, or block your transmissions at our sole discretion.

You agree that our exercise of such discretion does not make us the owners of UGC you post and that you will retain ownership as described above.

Restrictions on User-Generated Content. As a condition of these Terms of Use, you agree not to:

• Upload, post, transmit, or otherwise make available any UGC that is unlawful, harmful, hateful, threatening, abusive, harassing, libelous, defamatory, obscene, vulgar, pornographic, profane, racially disparaging, indecent, or invasive of another’s privacy.

• Upload, post, transmit, or otherwise make available any UGC that constitutes or encourages illegal activity under criminal or civil law.

• Upload, post, transmit, or otherwise make available any UGC that is false, misleading, or fraudulent.

• Upload, post, transmit, or otherwise make available any UGC that you do not have a right to make available under any law or contractual or fiduciary relationships (such as inside information or proprietary and confidential information learned or disclosed during employment or under nondisclosure agreements).

• Upload, post, transmit, or otherwise make available any UGC that violates or infringes upon the rights of others, including UGC that violates patent rights, copyrights, trademark rights, privacy rights, publicity rights, trade secret rights, confidentiality rights, contract rights, or any other rights of any individual, living or deceased, or any legal entity.

• Upload, post, transmit, or otherwise make available any UGC that contains the image, name, or likeness of anyone other than yourself, unless (i) that person is at least eighteen years old and you have obtained their express written permission or (ii) that person is under eighteen years old and you are their parent or legal guardian.

• Request or solicit any personal or private information from any individual.

• Request or solicit money, goods, or services for private gain.

• Upload, post, transmit, or otherwise make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.

• Upload, post, transmit, or otherwise make available any UGC that contains advertising, promotions, or marketing, or which otherwise has a commercial purpose.

• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity.

• Violate any local, state, national, or international law, rule, or regulation.

By posting User-Generated Content, you represent and warrant that (i) you own or otherwise control all rights to the UGC and have the right to grant the license set forth in these Terms of Use; (ii) the UGC is accurate; and (iii) you have read, understood, and ensured that your UGC fully complies with these Terms of Use and applicable laws, and will not cause injury to any person or entity.

Your Feedback

Home Contractor llc do not claim ownership of User-Generated Content you post on this Site, any Feedback you provide will be considered our exclusive property. By submitting Feedback through this Site, you assign to us all worldwide rights, title, and interests in your Feedback, including all copyrights and other intellectual property rights.

We are entitled to use, exploit, practice, make, copy, disclose, publicly display, perform, distribute, improve, and modify any Feedback you submit for any purpose, without restriction and without compensating you. Therefore, please do not send us any Feedback that you do not wish to assign to us.

Texting

You acknowledge and agree that our text messaging program is classified as an “other application” under these Terms of Use. Standard messaging rates from your carrier apply to your entry or submission message, our confirmation, and all subsequent SMS or MMS communications. While we do not charge for the content, you may incur charges from your cell phone provider. Please consult your wireless carrier for details on your messaging plan. Your carrier may impose limitations on messages or charges that are beyond our control.

We are not responsible for any delays or failures in the delivery of SMS or MMS messages, as their delivery depends on effective transmission from your network operator and processing by your mobile device. SMS and MMS message services are provided on an AS-IS basis.
